Developer accuses town of anti-Hasidic bias in denying permits for 2,600-home project

A standoff over permits to start a massive housing project in the Catskills has erupted into a federal discrimination case, with the developer accusing town officials of conspiring to stop an influx of Hasidic families.

The lawsuit was filed by a group that spent $9.5 million in 2020 to buy the land and fully approved plans for Lost Lake Resort, a 2,627-home community that sputtered to a halt before any houses had been built. The development site takes up 3.3 square miles in Forestburgh, a rural Sullivan County town with only about 800 residents.

The suit follows Forestburgh's denial of several building permits for initial homes and a 10-month review of that decision by the town's Zoning Board of Appeals, which ultimately upheld it with a 35-page ruling on Nov. 15.

In their 90-page filing, attorneys allege the town is trying to thwart a once-welcomed project out of hostility to the Hasidic Jews likely to buy homes there. They denounced the zoning board review as a "sham" in which lawyers from the same firm represented both the town officials and the board that was weighing their permit denial.

"Plaintiffs were repeatedly denied a fair and impartial review of their appeal," attorneys Eric Treene and Steven Barshov wrote.

Town officials contend they denied permits because the new owners changed the nature of the project, which was envisioned as an upscale resort community in which many of the homes would be vacation getaways, not year-round dwellings.

In its ruling, the zoning board said that the developer proposed extensive changes and that "the totality of the changes is strong evidence that the housing development Applicant intends to build is materially different than the Resort Project that was approved."

The developer's attorneys counter that the town is grasping for excuses and that the project will be built as approved, including the 18-home golf course.

The case demands the town fairly review the permit applications and seeks an unspecified amount in damages. It alleges violations of the federal Fair Housing Act, the U.S. and New York constitutions and other state laws.

"In America no government may tell people where they are welcome to live and where they are not based on their religion,” Treene said in a statement about the case. “This has become an all-too-familiar experience for Orthodox Jews in many New York communities, and it must end.”

The project was granted a zoning change in 2011 and consisted of 2,557 single-family houses, 30 cottages and 40 condominiums, along with an 18-hole golf course and other amenities. The community was to be built in seven phases with 400 homes and the first nine holes of the golf course in the first phase, approved in 2014.

Town officials cheered the development's start at a ribbon-cutting ceremony that year. The Dallas-based developer, Double Diamond Companies, spent millions building roads and installing miles of water and sewer pipes and drainage systems, according to the lawsuit. But after selling only about 150 housing lots, Double Diamond abandoned the project and put the property up for sale.

Mordechai Halberstam, a Rockland County builder, told the Times Herald-Record in 2020 he and his family had bought the Lost Lake property and planned to carry out the approved plans. He said they spent $13.3 million in all for the land and related assets, including mortgages Double Diamond held on 60 undeveloped housing lots that it had sold.

Barshov, one of the attorneys in the lawsuit, said in a statement that the developer had bought the project because all approvals were in place and building permits for the first phase could be issued at any time.


“The only reason home construction is not occurring is because Town officials have made it crystal clear: Hasidic Orthodox Jewish developers and homeowners are not welcome in Forestburgh,” he said.

Lost Lake files discrimination complaint against Forestburgh

FORESTBURGH – After the Forestburgh Zoning Board of Appeals (ZBA) denied building permits to the developers of the Lost Lake Holdings LLC property, which was also appealed, a new complaint has been brought forth against the town on the basis of discrimination and antisemitism.

The official complaint was released December 16 and was drafted by Eric W. Treene, partner at Storzer and Associates, P.C. and Steven Barshov, partner at Sive, Paget, and Riesel, P.C.

The plaintiffs in the complaint are named as Lost Lake Holdings LLC and Mishconos Mazah LLC.

The defendants are named as the Town of Forestburgh, as well as its Town Board, ZBA, Town Supervisor Dan Hogue Jr., Chair of the Forestburgh Planning Board Richard Robbins, Town Building Inspector Glenn Gabbard, and Town Assessor Dennis Ketcham.

The complaint was filed in the United States District Court for the Southern District of New York.

Multiple complaints were alleged within the statement. The report essentially states that when the project was spearheaded by Double Diamond LLC, it received support and praise from the town. However, it alleges that since the property was purchased and the project was guided by Hasidic Orthodox Jews, the sentiment has changed.

Also included in the complaint were multiple allegations of instances of “antisemitic animus” within online forums and from recorded statements from members of the community from past public meetings. There are also allegations of antisemitism within other official documents from the town, such as the initial denial letter of the building permits.

The complaint additionally alleges that it was targeting the Hasidic Orthodox Jewish owners of Lost Lake Holdings LLC when the Town Board voted to increase in “Parks and Playground” fees from $200 per lot to $2,000 on July 2, 2021. The complaint says this increase would spike the cost of developing future phases of the project to nearly $4 million.

The statement concludes this section of the complaint by stating “upon information and belief the increase in the Parks and Playground fee was motivated by a bias against Hasidic Orthodox Jews in an effort to prevent Plaintiffs from constructing the Project.”

Another claim within the complaint is on the town’s alleged misuse of the Escrow accounts that were originally created and set aside by Double Diamond, stating “the Town Board intended to and did misuse the Lost Lake Escrow to pay for consultant and outside legal expenses incurred in connection with the review of a building permit application, which was not authorized in the original PDD law and by using them without limitation and for purposes unrelated to any reasonable oversight of the construction of the Project.”

It goes on to allege that the town misused the escrow account in order to research the town’s ability to block the Plaintiff’s construction of the project.

Other complaints within the report were alleged instances of the town’s non-compliance with Freedom of Information Law (FOIL) requests by allegedly withholding specific records, the impacts of the various boards’ decisions on the Plaintiffs, their project plans, and the Orthodox Jewish community.

“Federal civil rights laws, the Constitution, and New York law all speak in one voice on the central issue of this case: in America no government may tell people where they are welcome to live and where they are not based on their religion,” said Eric W. Treene, attorney for the plaintiffs.

The complaint lists 22 counts of alleged violations against the Plaintiffs rights.

In the prayer for relief, the Plaintiffs requested that the denial of the building permits by the ZBA be made void and invalid, multiple declarations of the various violations of the Plaintiffs rights. It also requests an award of compensatory, consequential, presumed, and punitive damages against the Defendants in favor of the Plaintiffs.

“This developer bought the Lost Lake project because the prior owner had obtained all the approvals needed so building permits could be issued at any time and homes built,” said Steven Barshov of Sive, Paget, and Riesel, P.C., “The only reason home construction is not occurring is because Town officials have made it crystal clear: Hasidic Orthodox Jewish developers and homeowners are not welcome in Forestburgh.”

Town of Forestburgh Supervisor Dan Hogue told the Democrat that the town withholds comment due to pending litigation at this time.

Forestburgh, New York, population 808, is a small town on the Neversink River in Sullivan County. And just last week, their monthly Town Board meeting, included testimony from Rabbi Yeruchim Silber and Rabbi Avi Schnall of Agudah’s New York and New Jersey offices.

The story begain in 2011, when the Town Board rezoned the 3.3 square miles of land owned by Double Diamond, a Texas developer, to authorize the building of 2,557 single-family homes, along with cottages and townhouse-style condominium units, for a total of 2,637 residential units, along with multiple recreational and community amenities. In 2013, the Town Board granted Double Diamond final subdivision and site plan approval for the first phase of the project, consisting of 400 single-family home lots and the first nine holes of the project’s golf course.
In 2020, Lost Lake Holdings, an Orthodox Jewish group, bought the project from Double Diamond. They immediately encountered expressions of anti-Semitic opposition in the community. Then the town denied their application to develop the area.

Lost Lake Holdings is now bringing a federal lawsuit against Forestburgh. The suit alleges that the town has engaged in numerous actions to block construction of homes in the project, all as part of an effort to prevent Hasidic Orthodox Jews from moving to the town.

Rabbi Silber, Agudah’s director of New York government relations, described at the meeting the role of Agudath Israel in protecting religious liberties and how numerous municipalities have put up obstacles to prevent Orthodox Jewish expansion. He made clear that Agudah supports Lost Lake Holding’s lawsuit and will be monitoring it. But, most importantly, he asked the board to reconsider their oppositions and to allow the project to proceed.

Rabbi Schnall, director of Agudah’s New Jersey office, reviewed the history of some of the obstacles placed in the path of the group, among them an increase of 1000% in parkland fees. He also quoted a previous town supervisor who said, “These are not the visitors we want to attract.” Rabbi Schnall pointed to his experience in Jackson, New Jersey, where Agudath Israel filed a federal lawsuit after similar difficulties were encountered.

“Agudath Israel will continue to forcefully advocate on behalf of Orthodox Jews and push back against discrimination,” said Rabbi Silber. We stand with Orthodox Jews of Forestburgh, as we have stood with those of Jackson, Blooming Grove, Chester and other areas, who encountered discrimination and hate because of their religion.”
