House Speaker Paul Ryan opposes Senate deal to stabilize Obamacare exchanges

House Speaker Paul Ryan announced his opposition to a deal to stabilize Obamacare's exchanges shortly after President Trump bashed it.
Ryan's spokesperson Doug Andres told the Washington Examiner Wednesday the speaker didn't see anything in the bipartisan deal that changes his view that "the Senate should keep its focus on repeal and replace of Obamacare."

Schumer calls on McConnell to send bipartisan health care bill to floor this week

Senate Minority Leader Charles Schumer (D-N.Y.) called on Senate Majority Leader Mitch McConnell (R-Ky.) Sunday to bring a bipartisan short-term ObamaCare stabilization deal to the Senate floor this week, despite uncertain support from President Trump.

"This is a good compromise. It took months to work out. It has a majority. It has 60 senators supporting it, we have all 48 Democrats, 12 Republicans. I would urge Senator McConnell to put it on the floor immediately, this week," Schumer told NBC's Chuck Todd on "Meet the Press" on Sunday.

"It will pass. It will pass by a large number of votes. That'll put pressure on the House because let's not forget what this bill does is prevent premiums from going up," he continued.

"If Republicans think that if premiums go up they're going to avoid the blame, if Senator McConnell thinks that, he's wrong," he said.

Schumer's comments come after Trump said on Thursday he would be open to the bipartisan solution put forth by Sens. Lamar Alexander (R-Tenn.) and Patty Murray (D-Wash.). But he had criticized the plan prior to those comments.

“We will probably like a very short-term solution until we hit the block grants,” Trump said. “If they can do something like that, I'm open to it.”

Can President Trump And Rand Paul Save Healthcare?

Last week, Donald Trump signed a new executive order facilitating more flexibility for consumers of health insurance.

The order allows for more flexibility in purchasing insurance across state lines, and greater freedom for both small businesses and groups of consumers in creating “association health plans” (AHPs). In theory, this will broaden access to the benefits currently enjoyed only by those with employment-based insurance, and other types of group insurance.

The order also paves the way for healthcare reforms long favored by Senator Rand Paul (R-KY) who believes the reforms will help bring down healthcare costs.

In an op-ed for Breitbart, Paul writes:

“Millions of Americans will be eligible to band together to demand less-expensive insurance. The 28 million individuals left behind by Obamacare will now be eligible for inexpensive insurance.

How will it work? Well, nationwide associations like the National Restaurant Association will be allowed to form groups across state lines and, with the leverage of size, demand Big Insurance bring down their outrageous premiums.

Many of the 28 million people left behind by Obamacare who still don’t have insurance work low-wage jobs in our fast food restaurants. The President’s decision today will allow workers from two million restaurants to come together to form a buying group and through sheer size get cheaper and better insurance.

Millions of people will be eligible for the same group insurance that big corporations offer. In fact, Health Associations may grow to be larger than the largest of our corporations. Currently, about half of private insurance is cross-state, self-insured ERISA plans, and most employees love them. The President’s action today will allow the millions of people in the individual market an escape route to group insurance.”

Why Do We Need an “Escape” From the Individual Market?

But why should people need an “escape route to group insurance” as Paul describes?

Well, as anyone who’s had to buy health insurance in the non-group market knows, the “independent market” in health care is often an unpleasant ordeal. It’s a small part of the market, and prices are high. Large well-capitalized firms prefer to focus on the more lucrative group insurance market.

This state of affairs, however, isn’t due to some law of nature or some immutable reality of human behavior.

The fact that the independent market is so small and unresponsive is due to decades of public policy that favors group markets, and drives up costs for the independent market.

To see some of the origins of this problem, we need to go back to the 1940s.

As asked in a 2009 NPR article, “How did Americans end up with a system in which employers pay for our health insurance? After all, they don’t pay for our groceries or our gas.”

The answer lies in policies that encouraged the creation and spread of health insurance.

The concept of health insurance in the United States began in the late 1920. From there, it grew into a nationwide industry, and it was helped along by the federal government:

In 1942, the Roosevelt administration imposed price controls on wages. Offering health insurance as a fringe benefit thus became an easy back-door way to raise wages.

More changes followed. Mike Holly of Mises.org explains how “In 1945, buyer monopolization begun after the McCarran-Ferguson Act led by the Roosevelt Administration exempted the business of medical insurance from most federal regulation, including antitrust laws.”

By the 1950s, federal law began to favor not just any health insurance, but specifically group health insurance.

Holly says, “In 1951, employers started to become the dominant third-party insurance buyer during the Truman Administration after the Internal Revenue Service declared group premiums tax-deductible.”

The Individual market then became even more irrelevant in the 1960s with the creation of Medicare and Medicaid, which were types of group coverage themselves. This drove up prices for all types of insurance as it subsidized demand.

By 2013, before Obamacare took effect, 31 percent of the population was covered by Medicare or Medicaid. An additional 50 percent was covered by employer-based insurance. Before Obamacare started requiring that the uninsured purchase insurance through the independent market, only four percent of the American population was getting insurance through non-group health insurance. Since then, with Obamacare’s mandated coverage, the market has increased to only seven percent, as of 2016.

In recent decades, state governments have also been adding numerous mandates to health insurance coverage that required certain types of medical care, such as mental health care and prenatal care, be included. This drove up costs and prices for everyone, but it especially impacted the non-group market where costs and risks were not spread out among members of a large group. With the introduction of Obamacare, these mandates became even more numerous, and costs in the individual market rose even more.

This is where the Trump executive order comes in. It allows small employers, professional associations, and presumably other small groups to enter into AHPs that would offer similar advantages as group plans.

The order in many ways reflects the provisions of 2003 legislation that never passed, but was reintroduced earlier this year. Back in March, NPR noted the basics of the legislation, which appear to apply to Trump’s order as well:

“Plans from associations could offer stripped down coverage and would have more latitude in setting premiums than regular plans in the small-group market. They could operate in multiple states and generally avoid state-mandated benefits and other state insurance rules.

Under the Republican bill, association health plans still couldn’t discriminate against individuals based on their health, but they could charge higher premiums to companies with sicker workers.”

The idea behind the executive order here, however, is that even when older, sicker consumers join an AHP, firms would compete to keep costs down while increasing coverage or keeping it stable. This, after all, is what already often happens in employer-based group coverage — even in spite of crippling government regulation.

Critics of the plan assume that markets will remain static, and, unlike markets in food, transportation, and clothing — which have declined as household expenses for middle- and low-income households — healthcare prices will become increasingly unaffordable even for the middle class. But even in housing, where overall prices have increased, square footage per unit has increased in both multifamily and single-family units. In other words, healthcare seems to be the only industry where it can be assumed that quality (i.e., coverage) will go down as prices increase.

Experience would suggest that this only happens in the presence of ongoing government intervention. As we’re noted many times at the Mises Institute, the story of healthcare in the United States is one of rapidly increasing government subsidy of healthcare and ever-increasing regulation. Both work to increase prices.

Moreover, in spite of the tiny baby steps made toward deregulation by the Trump executive order, it’s unlikely that this move will be accompanied by any significant changes in other regulations that might pave the way for more competition and more production on the part of service providers. Policymakers will continue to cripple markets with anti-competitive regulations that limit healthcare facilities and personnel. Then, when markets fail to overcome these barriers, the elites will claim “market failure” and demand even more regulations, and more subsidies.

Why AHPs Were Undercapitalized When Tried

Critics of the new executive order also claim that in the 1980s — when AHPs were more easily formed under the federal law of the time — many providers were undercapitalized, provided poor service, and were prone to overpromising what they could deliver.

However, if we want real insight into why AHPs in the past have been undercapitalized — or lacking the robustness of the employer-based market — we need look no further than the federal government to understand why.

After decades of controls on interstate purchases, and in the wake of a tax code that favors employer-based insurance, who can be surprised that the markets for other group plans and the individual market are now under-developed? Essentially, health insurance markets have lost decades of innovation, competition, and capitalization outside the employer group market thanks to federal law.

Now we’re being told that allowing people to buy group insurance outside the usual straitjacket of federal policy is unworkable. It’s not unworkable, of course, it’s just a market that has been all but destroyed by government intervention.

Now, the only way the market for AHPs can develop and become competition and well-capitalized is to let it exist. It remains to be seen if that will ever be allowed beyond the short term.

Medicaid, Medicaid, Medicaid. Subsidies, subsidies, subsidies. Regulations, regulations, regulations. Bailouts, bailouts, bailouts.

This is all we hear from the sanctimonious politicians on health care.

What about those who don’t want subsidies but don’t want crushing regulations and market distortion that force them to pay the equivalent of another mortgage? Nothing Congress has attempted thus far has addressed those people. Trump’s executive order, while modest in scope and authority, is the first attempt to at least recognize the forgotten man in the health care debate.

Insurance bailouts create monopoly

To understand the utility of Trump’s virtuous, though limited, executive order on health care, we must understand what Obamacare has really done: Obamacare threw us out of our homes, locked us in a burning house, supplied fuel to the inferno, and barred the escape route for the trapped victims. Due to the limited statutory authority of the president, this executive order will not rebuild our homes or even put out the inferno, but it will offer us a narrow escape route.

Obamacare, with the illegal cost-sharing subsidies, had three major effects. First, the regulations severely raised the cost of insurance. Next, the subsidies encouraged the insurers to hike their prices even more without fear of market backlash. Third, millions who don’t get employer-based insurance but are not subsidized were scorched when Obamacare burned down their previous insurance. Worse, the requirement to purchase the insurance products has trapped those people into the system with no ability to fight back with any typical consumer leverage.

The executive order is ending the cost-sharing subsidies and opening up new competing markets. This will force companies to compete and serve as a check on endless price increases in the long run, contrary to what the political class is saying.

The best thing about the Trump order on health care was ending the illegal cost-sharing subsidies. The subsidies for individuals’ premiums — not the same thing — are already appropriated by Congress.

The details of Trump’s executive order

Trump’s executive order has three major parts.

Association plans: It expands the definition of small businesses that are eligible for health association plans, in which they can pool resources and purchase group plans that are exempt from Obamacare regulations and other state regulations under The Employee Retirement Income Security Act of 1974 (ERISA). It is unclear how this will change the dynamic, given that individuals or non-profit associations still won’t be able to apply, due to Obamacare and state regulations. Opening up such plans for individuals would be a game-changer for competition, but Trump can’t do that through executive order. Thus, the benefit is unclear until HHS writes the regulation, within 60 days.

Equal tax treatment for individual market plans: The order gives the IRS, HHS, and several other agencies four months to write a rule expanding the use of Health Reimbursement Arrangements (HRAs) to allow employers to use them for contributions to employees’ insurance premiums as well as out-of-pocket payments. HRAs are the employer equivalent of HSAs for individuals, in which consumers are empowered and incentivized to pay out of pocket for health care with pre-tax funds. A more revolutionary change would expand HSAs to include premium payments as well, but that would be outside the president’s authority. Expanding HRAs to include premium payments, though, seems to be within his authority because it was Obama’s IRS that made the rule in 2013 excluding premium payments from HRAs in the first place.
The important potential outcome of this change would be to encourage more small businesses to offer their employees defined contributions to their personal plans in the individual market, even if they feel they can’t afford to pay for a group plan. This is a very positive step that not only opens more of a market for individual plans but also fixes part of the “original sin” of health care, whereby people rely on group plans rather than shopping around like individual consumers the same way they do for auto and homeowner’s insurance.

It is still unclear, however, whether this would apply only to businesses with fewer than 50 employees, because under Obamacare, larger businesses must offer group plans anyway because of the employer mandate. Thus, without repealing the employer mandate, which is out of Trump’s hands, the effect of this change will be modest.


Unregulated, short-term plans: The most significant change is the restoration of short-term, limited-duration health insurance plans (STLDIs). The other changes won’t amount to much if there is no option for consumers to escape the regulatory hell and create a new market-based corner in medical insurance with multiple choices and competition. Only a new option will make HRAs, expanded associations, and the pressure of cutting off subsidies to insurers worthwhile. This is where STLDIs come into play.
Under Obamacare, insurers were always able to offer short-term plans, defined as lasting for less than a complete year of coverage, that were exempt from all of the regulations. It was the best-kept secret of Obamacare — the narrow passage of escape from the hidden inferno for many middle-class families. However, by the time the pinch of Obamacare became really evident and people began using these plans in large numbers, Obama’s HHS limited them to three months and made them non-renewable, essentially gutting most of these plans. Trump’s order merely countermands Obama’s order and restores Obamacare to its original implementation. Thus, there can be no complaints of abusing executive authority.

This is where the potential to collapse Obamacare and offer an escape route comes into play and why the pundits are wrong about the ill effects of getting rid of the insurance bailout. Now there is a permanent check and balance on the insurance cartel. To the extent that they want to raise their premiums in response to the regulations and lack of subsidies, more and more people will take the off-ramp of the short-term plans — certainly the millions without subsidies in the individual market, but even some at the lower end of the subsidy scale and those getting increasingly pinched in the group market. It will also create a new competitive market for all those insurers who left the Obamacare exchanges to compete for the best short-term plans. And if these individual plans take off, the change to HRAs will further help, because now there will be worthy individual market plans for employers to fund that are cheaper than providing group plans.


Obviously, in the long run, we need massive systemic reform to the anti-market interventions on the supply side of health care and to cut out the third-party payer system, as well as repealing all of Obamacare’s regulations. We need the ability of individuals to purchase all health-sharing and health association plans across state lines without the individual mandate penalty for not buying cartel insurance. We need price transparency. We need to take Medicaid away from the cartel and give it straight to the people who need it. We need to end the government empowerment of the insurance cartel to price-fix the consumer into oblivion, and we must equalize treatment of alternatives to the traditional insurance model at all levels of government.

While Rand Paul suggests that Trump’s order would allow individuals, not just small businesses, to purchase association plans, I doubt HHS has the authority to do this. However, Rand Paul is right to suggest that these reforms, if implemented properly by HHS, have the potential to commence a domino effect to force broader free-market changes beyond anything congressional Republicans were offering with their phony repeal bills. It is to be hoped that the administration will follow through with these promises. The positive effects should place the pressure on Congress to enact true market-based reform.
