Mamakating, Bloomingburg officials file racketeering lawsuit against developer

BLOOMINGBURG -- The Town of Mamakating and Village of Bloomingburg have filed a lawsuit under a federal racketeering law against developer Shalom Lamm alleging, among other charges, corruption, bribery and mail fraud, according to a spokesperson for the town.
The lawsuit ranges over a number of years, according to Samantha Friedman, including "false claims" made by Lamm and his supporters that the communities' opposition to his Chestnut Ridge housing complex is the result of anti-Semitism. The 396-unit complex has been marketed to Hasidic Jews.
The federal Racketeer Influenced and Corrupt Organizations law, known as RICO, has been used primarily over the years to combat organized crime syndicates. The suit was filed Tuesday, Friedman said, in U.S. Southern District Court in White Plains

BLOOMINGBURG - The Town of Mamakating and Village of Bloomingburg have filed a wide-ranging lawsuit under state and federal racketeering laws against developer Shalom Lamm and others, alleging, among other charges, corruption, bribery and mail fraud.
The lawsuit ranges over nearly a decade of incidents, including what the suit calls "false claims" made by Lamm and his supporters that the communities' opposition to his 396-unit Chestnut Ridge housing complex, which has been marketed to Hasidic Jews, is the result of anti-Semitism.
Lamm brought a $25 million suit in federal court in September alleging "pervasive government-sponsored religious discrimination," a charge officials have vehemently denied.
Philip Simpson, co-counsel for the communities, said their suit was not asking for a specific amount of money but rather it was asking the court to give the town and not the village legal jurisdiction over the development's land, that the development be halted and that a federal monitor be appointed to oversee future development.
The federal Racketeer Influenced and Corrupt Organizations law, known as RICO, has been used since 1970 to combat organized crime syndicates. The suit was filed Tuesday in U. S. Southern District Court in White Plains.
The 158-page complaint presents a highly detailed and dramatic scenario in which two "bucolic communities" are depicted as being "under siege in a hostile takeover spearheaded by a racketeering enterprise headed by Shalom Lamm and Kenneth Nakdimen."
The complaint alleges that Lamm and his business partner Nakdimen have acted "through highly sophisticated covert and overt schemes of fraud, bribery, intimidation and corruptly influencing public officials" in violation of state and federal law.
The suit names former Mamakating supervisor, developer and former Lamm partner Duane Roe, and former village mayor Mark Berentsen, along with unnamed "co-conspirators" who are alleged to have illegally registered to vote in Bloomingburg elections.
Michael Fragin, a spokesman for Lamm and his supporters, released a statement Tuesday calling the lawsuit "a public relations stunt filled with recycled allegations previously rejected by New York courts."
The statement said they were confident of a quick dismissal and that "taxpayers of Mamakating and Bloomingburg should be deeply disturbed by the wasting of their tax dollars in this folly.
