Rep. Jordan Grills FBI Director: Did Agent Who Sent Anti-Trump Texts Bring Dossier to FISA Court?

At the House hearing, Jordan (R-Ohio) zeroed in on Peter Strzok's work on the Hillary Clinton email investigation and asked whether Strzok had anything to do with the anti-Trump dossier.

Strzok was moved off Special Counsel Robert Mueller's Russia investigation over the summer after the text messages were discovered.

"If you kicked everybody off of Mueller's team who was anti-Trump, I don't think there'd be anybody left," said Jordan, alleging there is "more" behind Strzok's departure from Mueller's team.

"My hunch is it has something to do with the dossier," he told Wray.

Jordan laid out a scenario in which he said he believes it may have been Strzok who brought the dossier to a FISA court to obtain clearance for surveillance on members of the Trump campaign.

"If you had the FBI working with the Democrats' campaign, taking opposition research and dressing it all up and turning into an intelligence document and taking it to the FISA court so they could spy on the other campaign that is as wrong as it gets," said Jordan.

He said Wray could easily disprove his allegation by releasing the FISA application to Congress. Wray said he could not legally release the information and that an inspector general is looking into the matter.

Wray said the FBI is having "extensive interaction with both intelligence committees on our interaction with the FISA court."

Meantime, Fox News has learned that a senior Justice Department official was demoted this week amid an ongoing investigation into his contacts with the opposition research firm responsible for the anti-Trump "dossier."

The Incredible Tale of a Reckless, Partisan FBI Agent and Our Partisan Bureaucracy

Peter Strzok’s story will hurt public trust in the federal government at the worst possible time.

If the story hadn’t been verified by virtually every mainstream-media outlet in the country, you’d think it came straight from conspiratorial fever dreams of the alt-right. Yesterday, news broke that Robert Mueller had months ago asked a senior FBI agent to step down from his role investigating the Trump administration. This prince of a man was caught in an extramarital affair with an FBI lawyer. The affair itself was problematic, but so was the fact that the two were found to have exchanged anti-Trump, pro-Hillary Clinton text messages.

Here’s where the story gets downright bizarre. This agent, Peter Strzok, also worked with FBI director James Comey on the Clinton email investigation. In fact, he was so deeply involved in the Clinton investigation that he is said to have interviewed Cheryl Mills and Huma Abedin, and to have been present when the FBI interviewed Clinton. According to CNN, he was part of the team responsible for altering the FBI’s conclusion that Clinton was “grossly negligent” in handling classified emails (a finding that could have triggered criminal liability) to “extremely careless” — a determination that allowed her to escape prosecution entirely.


After the Clinton investigation concluded, Strzok signed the documents opening the investigation into Russian election interference and actually helped interview former national-security adviser Michael Flynn.

In other words, it looks like a low-integrity, reckless, biased bureaucrat has played an important role in two of the most important and politically charged criminal investigations of the new century. Yes, it’s good that Mueller removed Strzok when he discovered the text messages. No, Strzok is not solely responsible for the conclusions reached in either investigation. But his mere presence hurts public confidence in the FBI, and it does so in a way that further illustrates a persistent and enduring national problem: America’s permanent bureaucracy is unacceptably partisan.



Remember President Obama’s second term, when the IRS Tea Party–targeting scandal erupted? The bureaucrat at the fulcrum of the scandal, Lois Lerner, was unabashedly partisan, launching a comprehensive and unconstitutional inquiry into conservative groups even as she was “joking” that “she wanted to work for the pro-Obama group Organizing for America.”


It’s hard to overstate the effect of the IRS scandal on conservative confidence in the federal government. Yes, there were some progressive groups that faced scrutiny, but the sheer scale of the attack on conservative groups was unprecedented. The IRS sought confidential donor information, passwords, and information about the political activities even of family members of those involved with some scrutinized groups. I remember. I represented dozens of these organizations.


When it came time to launch a criminal investigation of the IRS, the Obama Department of Justice put an Obama donor in charge of the probe. The decision to offer her the job was inexcusable, as was her decision to accept. At a time when half the country was losing confidence in the integrity of its public servants, the Obama administration raised its hand and extended a big middle finger.

While there are certainly some biased, partisan conservatives in the federal bureaucracy, the ideological imbalance in the civil service is striking. It’s not quite at university-faculty levels, but it’s getting close.


For example, in the 2016 election cycle, Hillary Clinton received an astounding 95 percent of all federal-employee donations. The Hill created two charts that show the staggering disparity, in total and by department:



The danger here isn’t just the kind of naked display of partisan bias that we saw in the Obama IRS. It’s also the emergence of groupthink. As we know from other liberal-dominated enclaves, such as academia and the mainstream media, ideological uniformity can lead to a startling degree of ignorance and incompetence. It’s hard to govern (or educate, or report on) an entire country when you aren’t sufficiently exposed to contrary perspectives and experiences.

For more than a year, I’ve been challenging conservative readers to look at Trump’s actions and imagine how they’d react if Democrats were behaving the same way — to apply the same standards to their team that they’d apply to their opponents. Now, I want to challenge my progressive readers: Consider how you would respond to the federal bureaucracy with the opposite ideological imbalance. Would you have confidence that it would apply the law and Constitution fairly? Would you be alarmed if you found that a senior FBI agent so biased and reckless was playing a key role in the investigation of a Democratic president?

I’m no “deep state” or “soft coup” conspiracy theorist. I know there are progressives who do excellent work in the bureaucracy, and I know there are also incompetent conservatives. As we’ve learned, incompetence, bias, and sleaziness know no ideological bounds. But unless our nation can diversify its civil service (and unless civil servants themselves stop acting recklessly and foolishly) public trust will continue to erode, and everything will be viewed through a partisan lens, all the time.

It is to Robert Mueller’s credit that he took swift action against Strzok. It’s a problem that, as the Wall Street Journal observes, he “kept this information from House investigators.” For a critical mass of the public to have confidence in Mueller’s investigation, it must be as transparent and accountable as humanly possible. A proper investigation into Russian interference in our election is vital to the health of our democracy. A biased and opaque probe, however, will do far more harm than good.

Robert Mueller has got some explaining to do

Has special counsel Robert S. Mueller III’s investigation been contaminated? This very good question was asked by the very credible Michael Warren of the Weekly Standard. In my view, the simple answer is: yes.

Enough has been disclosed in recent weeks that would create doubts about the objectivity and honesty of Mueller’s Russia investigation. Specifically, recent reports suggest that Peter Strzok, the deputy head of counterintelligence at the FBI, was working on Mueller’s investigation until he was removed during the summer, after Mueller discovered he had exchanged text messages critical of Trump with a lawyer assigned to the probe, with whom he was involved romantically. Strzok, it turns out, was also responsible for editing then-FBI Director James B. Comey’s description of Hillary Clinton’s handling of classified emails, reportedly softening the language from describing Clinton’s actions as “grossly negligent” to “extremely careless.“ Oh and by the way, several of the attorneys on Mueller’s team have collectively given over $62,000 in political contributions to Democrats. Are we supposed to pretend that this doesn’t show any bias? One attorney in particular, Jeannie Rhee, has donated more than $16,000 to Democrats since 2008 and even defended the Clinton Foundation in a racketeering lawsuit. She also defended Clinton in a 2015 lawsuit that sought access to her private emails, as well as Ben Rhodes, deputy national security adviser under President Barack Obama, during the House Select Committee on Benghazi’s investigation. At a minimum, all of this suggests favoritism toward Clinton and the Democrats.

Because even the slightest hint of partisan impropriety could have a disqualifying effect on the investigation, Mueller has got some explaining to do — what he knows about bias in his organization, when he knew about it, and what he plans to do to fix the problem and correct the discrediting optics.

Simply put, Mueller needs to rehabilitate his standing as an impartial, objective investigator. He needs to take an unbiased look back at the Clinton probe and answer obvious questions about Strzok’s role.


As he does so, Mueller should not stiff-arm the public’s right to know the motives of the FBI and his own investigators. The credibility of Mueller’s inquiry is hanging in the balance. He should publicly reveal the facts, confirm the integrity of his team and make clear that neither he nor anyone working for him is functioning as the Trump haters’ vehicle. Otherwise, Mueller will allow his probe to become one more of the partisan, hand-to-hand-combat sideshows that seem to infect every corner of American politics.

I have been a defender of Mueller. And I think of him as a serious, credible adult. But it looks as though he’s made some mistakes in allowing potentially biased personnel decisions to distract from the investigation’s mandated nonpartisan mission. He needs to reassert himself and confirm that mistakes were made, that he is aware of them and that he is doing something to reassure the public that he is still in charge of his team. Only then will the public and others be able to decide whether his investigation should be redeemed. At this point, if Mueller remains silent, it will be tantamount to acknowledging that his investigation is corrupted by bias and meant only to pick a fight and contribute to the division in America.

Top Dems ask DOJ for possible evidence that FBI had 'political bias' against Clinton

The top Democrats on the House Judiciary and Oversight committees are asking the Justice Department to turn over documents they say could be "evidence" that the FBI showed "political bias or personal animus" toward former Democratic presidential nominee Hillary Clinton during the 2016 election.

Reps. Elijah Cummings (D-Md.) and Jerrold Nadler (N.Y.), the ranking members of the House Oversight and Government Reform and Judiciary Committees, respectively, called on two top Justice Department officials on Monday to share information about possible leaks from the FBI to True Pundit, a conservative website, during the bureau's investigation into Clinton's use of a private email server as Secretary of State.
“Our committees are now engaged in an investigation of allegations of politically-motivated misconduct at the FBI," the Democrats wrote in a letter to Attorney General Jeff Sessions and Deputy Attorney General Rod Rosenstein.

“The facts point to a coordinated effort by some in the FBI to change the course of the Clinton investigation by leaking sensitive information to the public, and by threatening to leak additional information after the investigation was closed," they continued, while asking for information about “politically-motivated misconduct."

The two Democrats asked whether True Pundit's reporting, which cited sources within the government, influenced the FBI’s decision to reopen the email probe shortly before the election.

McCabe draws blank on Democrats’ funding of Trump dossier, new subpoenas planned

EXCLUSIVE: Congressional investigators tell Fox News that Tuesday’s seven-hour interrogation of Deputy FBI Director Andrew McCabe contained numerous conflicts with the testimony of previous witnesses, prompting the Republican majority staff of the House Intelligence Committee to decide to issue fresh subpoenas next week on Justice Department and FBI personnel.

While HPSCI staff would not confirm who will be summoned for testimony, all indications point to demoted DOJ official Bruce G. Ohr and FBI General Counsel James A. Baker, who accompanied McCabe, along with other lawyers, to Tuesday’s HPSCI session.

The issuance of a subpoena against the Justice Department’s top lawyer could provoke a new constitutional clash between the two branches, even worse than the months-long tug of war over documents and witnesses that has already led House Speaker Paul Ryan to accuse DOJ and FBI of “stonewalling” and HPSCI Chairman Devin Nunes, R-Calif., to threaten contempt-of-Congress citations against Deputy Attorney General Rod Rosenstein and FBI Director Christopher Wray.

“It’s hard to know who’s telling us the truth,” said one House investigator after McCabe’s questioning.

Fox News is told that several lawmakers participated in the questioning of McCabe, led chiefly by Rep. Trey Gowdy, R-S.C.

Sources close to the investigation say that McCabe was a “friendly witness” to the Democrats in the room, who are said to have pressed the deputy director, without success, to help them build a case against President Trump for obstruction of justice in the Russia-collusion probe. “If he could have, he would have,” said one participant in the questioning.

Investigators say McCabe recounted to the panel how hard the FBI had worked to verify the contents of the anti-Trump “dossier” and stood by its credibility. But when pressed to identify what in the salacious document the bureau had actually corroborated, the sources said, McCabe cited only the fact that Trump campaign adviser Carter Page had traveled to Moscow. Beyond that, investigators said, McCabe could not even say that the bureau had verified the dossier’s allegations about the specific meetings Page supposedly held in Moscow.

The sources said that when asked when he learned that the dossier had been funded by the Hillary Clinton campaign and the Democratic National Committee, McCabe claimed he could not recall – despite the reported existence of documents with McCabe’s own signature on them establishing his knowledge of the dossier’s financing and provenance.

The decision by HPSCI staff to subpoena Ohr comes as he is set to appear before the Senate Intelligence Committee, which is conducting its own probe of Russian interference in the 2016 election.

Until earlier this month, when Fox News began investigating him, Ohr held two titles at DOJ: associate deputy attorney general, a post that placed him four doors down from his boss, Rosenstein; and director of the Organized Crime Drug Enforcement Task Forces (OCDETF), a program described by the department as “the centerpiece of the attorney general’s drug strategy.”

Ohr will retain his OCDETF title but was stripped of his higher post and ousted from his office on the fourth floor of “Main Justice.” Department officials confirmed that Ohr had withheld from superiors his secret meetings in 2016 with Christopher Steele, the former British spy who authored the dossier with input from Russian sources; and with Glenn Simpson, the founder of Fusion GPS, the opposition research firm that hired Steele with funds supplied by the Hillary Clinton campaign and the Democratic National Committee.

Subsequently, Fox News disclosed that Ohr’s wife Nellie, an academic expert on Russia, had worked for Fusion GPS through the summer and fall of 2016.

Former FBI Director James Comey, testifying before the House in March, described the dossier as a compendium of “salacious and unverified” allegations against then-candidate Donald Trump and his associates. The Nunes panel has spent much of this year investigating whether DOJ, under then-Attorney General Loretta Lynch, used the dossier to justify a foreign surveillance warrant against Page, a foreign policy adviser to the Trump campaign.

DOJ and FBI say they have cooperated extensively with Nunes and his team, including the provision of several hundred pages of classified documents relating to the dossier. The DOJ has also made McCabe available to the House Judiciary Committee for a closed-door interview on Thursday.

The Justice Department and FBI declined to comment for this report.
