Kiryas Joel, NYC plan 15-mile backup water pipeline; no word on who foots the bill

New York City and Kiryas Joel are planning a 15-mile pipeline that could supply backup water when needed by Orange County municipalities that use the city's Catskill Aqueduct.

The new water main would run beside the aqueduct, from New Windsor in Orange County to Gardiner in Ulster County, and draw water from the city's Delaware Aqueduct. The two giant water tunnels cross paths in Gardiner as they carry 1.2 billon gallons each day from reservoirs in Ulster and Sullivan counties, most of it bound for the city.

The planned pipeline would provide water whenever the Catskill Aqueduct is shut down for repairs. Potential beneficiaries include the village of Kiryas Joel, which has been building a separate 13.5-mile pipeline since 2013 to tap the aqueduct; and the city of Newburgh and town of New Windsor, both of which already rely on the same aqueduct.

New York City has budgeted $5 million to cover the cost of the pipe designs, which are expected to take about three years to complete.

But how much construction will cost and who will pay for it remains undetermined.

Any municipalities that plan to use the aqueduct bypass would likely share the construction cost, which could also be funded with federal and state grants, said Ted Timbers, a spokesman for the city's Department of Environmental Protection, the agency that runs the water system.

How long it will take to install the pipe after the three-year design process also is unknown. Timbers said similar projects have taken two to five years to complete, which means the pipeline may not be built and ready for backup use until at least 2027.

City officials presented the proposal last Thursday at a virtual meeting attended by representatives of several Orange County municipalities and county and state agencies.

For Kiryas Joel, the project would ensure an abundant - and expandable - backup supply after the Catskill Aqueduct has become the village's primary water source. Without Delaware Aqueduct access, the village of 33,000 would have to maintain its current well network for reserve use and continue adding new wells as its population and water use keep growing.


"Having a backup water supply is critical because NYC needs to have its water system out of use for repairs and maintenance very often," Kiryas Joel Administrator Gedalye Szegedin said by email. "Since Kiryas Joel will have all its water coming from the NYC system, having a reliable backup plan is a top priority."

Szegedin argued the project would have the added benefit of easing strain on groundwater supplies in places where Kiryas Joel has wells, avoiding potential competition with other private and municipal wells. It currently draws water in Monroe, Woodbury and Cornwall, as well as inside the village.

"Our wells in neighboring communities are a source of tension and litigation with the impacted communities," he said. "Therefore continuing to maintain and expand our groundwater supply is something that we need to avoid."

The pipeline idea dates back more than a decade, first suggested as a regional resource in reports by the Orange County Water Authority in 2010 and 2014.

It would tap the Delaware Aqueduct in Ulster County through Shaft 4, a vertical tunnel that extends deep underground to the aqueduct. And it would follow the path of the Catskill Aqueduct to Riley Road in New Windsor, where New Windsor and Kiryas Joel have their aqueduct taps.

New York City already connected the two aqueducts at Shaft 4 to allow Delaware water to flow into the Catskill tunnel when the Catskill water is too silty. That $21 million interconnection was completed in 2015.

Both the city of Newburgh and New Windsor increased their use of the Catskill Aqueduct after the chemical PFAS tainted their own water supplies. Newburgh switched entirely to aqueduct water after contamination was found in Washington Lake in 2016. New Windsor found PFAS traces in its new wells in 2019 and now uses both the aqueduct and wells, which were equipped with a state-purchased filter.

In an interview last week, New Windsor Supervisor George Meyers said the planned backup line "definitely is a plus for the New Windsor residents because it gives us access to the Delaware." But he sees it as a long-term prospect that will likely take 10 years to complete, and he opposes contributing to the construction cost.

"Am I paying for it?" he said. "No."

Stewart Airport and the village of Cornwall-on-Hudson also have Catskill Aqueduct taps. Cornwall-on-Hudson hasn't bought city water since 2020 because its own supplies were sufficient.

More than 70 communities and institutions in all in Ulster, Orange, Putnam and Westchester counties draw water from New York City's water system, using an average total of about 110 million gallons per day. State law allows any municipality in counties crossed by the aqueducts to buy city water, but each must keep an equal amount in wells or reservoirs to use when an aqueduct is shut down.

Kiryas Joel started planning its aqueduct connection more than two decades ago as a long-term supply for its growing population. Officials hope to finish the 13.5-mile-long pipeline and begin drawing water before the end of the year, using a temporary filtration plant. The last available cost estimate for the project as of last year was $94 million.

KIRYAS JOEL — More than 20 years ago, village leaders started planning an ambitious project to ensure their fast-growing community would always have enough water without relying on wells.

That vision is now in the home stretch. By the middle of 2023, after spending a decade burying a 13.5-mile pipeline across three towns in Orange County, Kiryas Joel officials hope to open a tap on one of New York City's aqueducts and start sending its reservoir water to homes and businesses in their village.

But challenges loom in the final stage, starting with another cost rise. The total price has climbed to roughly $118 million from $29 million since 2010, with the latest increase coming from the raised estimate for a filtration plant that will be built in Woodbury to treat the aqueduct water.

The $46 million plant is a major piece yet to be done. Still awaiting approval by the Woodbury Planning Board after almost two years of review, that plant could take two years to build. Kiryas Joel plans to use a trailer-mounted plant until then, which will limit its aqueduct use and force it to keep using its wells for a few more years.

Kiryas Joel leaders also are pressing for loan forgiveness to wipe out nearly $90 million in outstanding loan debt for the project. They expected to secure that aid — and spare their water users the repayment cost — through last year's federal infrastructure law, but so far have been told the pipeline is ineligible.

They continue to make their case for relief, even to the highest levels. Village Administrator Gedalye Szegedin appealed directly to President Joe Biden for help in October, seizing a rare opportunity to talk privately with the president at the IBM campus in Poughkeepsie before an event celebrating the company's $20 billion investment plans.

Szegedin says he explained to Biden his village's water needs and its big debt, thanked him for the infrastructure bill and asked him to intercede with the federal Environmental Protection Agency.

"I asked for his help with the EPA to make sure we stay eligible for some of the loan forgiveness," he said. "He asked a staffer to take notes and follow up."

Replacing wells
Kiryas Joel will use the Catskill Aqueduct to replace its network of wells, which have multiplied beyond its borders to three other towns to keep pace with growth. Once the village has switched entirely to New York City water, it plans to make its wells a backup source to use when the aqueduct is shut down for repairs.

The pipeline itself, two feet in diameter and buried beside roads, is almost fully installed, with just a few short stretches left. Kiryas Joel started laying it in 2013 and has crossed through Woodbury and Cornwall en route to Riley Road in New Windsor, where it will be connected to the aqueduct.

Once the tap is built and opened, Kiryas Joel is entitled to draw up to 3.8 million gallons per day based on its 2020 population of 33,000. That is far more than it currently needs. Daily water use averaged 2.1 million gallons in October, according to an Orange County Department of Health report.

Kiryas Joel's aqueduct limit will rise with its population in each future census. The treatment plant is designed for plenty of growth with a capacity of up to 6 million gallons a day, or almost triple the amount the village now uses.

The Satmar Hasidic community grew by 63% in the last decade and has several thousand homes being built or planned, mostly condominiums. A 1,600-unit complex still under construction got its first residents this year. A new proposal for 608 condos in 80 buildings is under review by the planning board.

Like other upstate communities that tap the city's Catskill and Delaware aqueducts, Kiryas Joel will have to pay for the water it draws. About 70 water systems, including New Windsor and the city of Newburgh, use the giant tunnels that carry 1.2 billion gallons a day to the city from reservoirs in Ulster and Sullivan counties.

The last work on Kiryas Joel's long connection is in New Windsor. Workers are burying black iron pipes behind businesses on Routes 32 and 94 — an off-road detour that avoided snarling traffic at the Five Corners intersection. A second detour is planned to finish the line and shorten the route by a half-mile, saving $1 million.

Debt relief
Kiryas Joel has borrowed about $96 million from the state Environmental Facilities Corp. for the project and so far repaid around $7 million, according to the lending agency. The village also got a $3 million state grant to fund the work.

Unless waived by the state, the loans will be repaid by residents and businesses on their water bills and by Kiryas Joel's housing developers. The village charges developers $8,500 per home to help pay for the aqueduct project.

Kiryas Joel hoped to erase the debt through the $1.2 trillion infrastructure bill Biden signed in November 2021. Of the $452 million New York is expected to get for water projects over five years, up to 49%, or $222 million, may be spent on grants or loan forgiveness for disadvantaged communities.

Sen. Chuck Schumer's staff worked with Kiryas Joel to secure that bill language and ensure the aqueduct project would qualify. But the Environmental Protection Agency determined that only loans taken after the bill signing were eligible. New York's Department of Health, which helps oversee water-project loans, took the same position.

Kiryas Joel argues that projects already in progress were supposed to qualify. But as a fallback position, it has asked the state to make the unbuilt treatment plant a new loan and then forgive that $46 million, since that would qualify even under the EPA's interpretation.

In addition to Schumer, the village's current and previous House members have supported its quest for relief. Then-Rep. Sean Patrick Maloney, who left office in December, and Rep. Patrick Ryan, the fellow Democrat who now represents New York's 18th Congressional District, co-signed a letter to the Department of Health in September, urging it to waive the debt for either the full project or just the treatment plant.

"Their project is extremely important to the residents of the Village and has the potential to help multiple communities in the region better access reliable drinking water," the two congressmen wrote in the Sept. 22 letter.

One modest piece of aid came through on Friday, when Congress passed a $1.7 trillion spending bill to fund the federal government through September. Amid thousands of grants that senators and House members earmarked for projects in their home states and districts was one from Schumer for Kiryas Joel: $1.5 million for the new water treatment plant.
